Peeping Into Employee Privacy Issues
Managing privacy in the workplace requires a balancing of rights. Employees have a right to privacy at work, even while they are on company premises and using company equipment or devices. Employers have a right to collect certain personal information about employees, but must also manage and protect employee privacy. 
 
How does privacy work when an employer conducts background checks or workplace surveillance? Can employers look at what’s on an employee’s company laptop or phone? What happens if there’s a privacy breach? Who gets to see employee information and what if an employee wants to see their own information? And what should employers do about ChatGPT and other AI technologies?

Roxanne Davis KC, QArb
MANAGING partner
Roxanne practices litigation with a focus on employment law, including human rights, privacy, and occupational health & safety matters. She represents both employers and employees in a wide range of complex employment law matters, including drafting employment agreements and workplace policies, advising on compliance with employment related laws, advising on terminations and negotiating settlements of wrongful and constructive dismissal claims.

Roxanne has also conducted workplace investigations as an independent investigator, including complaints of widespread sexual harassment in a manufacturing facility, and bullying and harassment in major financial and education institutions. She has also supervised workplace investigations conducted both internally and by external parties.

Additionally, Roxanne is certified by the ADR Institute of Canada as a Qualified Arbitrator. With over 20 years of experience balanced between representing employers and employees, Roxanne is well positioned to deliver fair and unbiased resolutions to workplace disputes.
Alex Norris
partner
Alex is a co-chair of Carbert Waite’s employment practice group. She advises both employers and employees on a multitude of employment issues, including terminations, workplace bullying and harassment, employee management, human rights issues, and disciplinary matters. She has experience representing clients before the Alberta Human Rights Tribunal, the Canada Industrial Relations Board, the Alberta Court of Justice (formerly Provincial Court) and the Court of King’s Bench of Alberta, as well as in commercial arbitrations and mediations.

Alex also practices general commercial and civil litigation and advises clients with respect to a broad range of individual and corporate disputes, including contractual disputes, insurance matters, and tort-based claims. She also has experience in construction matters, particularly with builders’ liens and delay claims.

Alex aims to provide common-sense advice to help clients achieve timely and cost-effective resolutions.
