Tariffs and Tribulations: A Survival Guide for Employers
Political unease, both at home and abroad, along with international trade uncertainty are impacting employers. Tariffs causing supply chain disruptions and increased costs may force businesses to make difficult choices. Downsizing, temporary layoffs, and permanent closures could be in the cards for some. Minimizing the impact on employees while minding the bottom line will be key. Canada’s recent attitude towards securing its borders and slashing immigration levels has had significant impacts on foreign workers in Canada. Employers filling critical labour shortages face additional barriers. How are employers to manage these unprecedented challenges?

Join partners Lucinda Wong and Stephen Torscher, as they explain changes to employment insurance and other government programs designed to help those impacted by US tariffs. They will explore three procedures for insolvent businesses, how each impacts the employment relationship, and when directors might be exposed to personal liability. They will highlight the various procedures that employers can still utilize to engage temporary foreign workers, challenges facing employees who are on work permits, and what considerations apply if an employer must lay off or terminate a temporary foreign worker. Finally, our team will provide some tips and tricks for managing temporary foreign workers and mitigating risks for employers in these trying times.

Stephen Torscher
partner
Stephen is a co-chair of the employment practice group. He provides trusted advice to clients on a wide range of labour and employment issues. His practice covers all aspects of employment relations from hiring to firing. He prides himself on providing practical answers to complicated questions.

Stephen has advised clients on a range of human resource matters including employment contracts, workplace policies, grievances and arbitrations, employee discipline, and terminations. He has provided strategic advice to vendors and purchasers of businesses in Alberta in order to manage transactional employee issues. He has acted as counsel in litigation concerning wrongful dismissal, human rights, employment standards, and labour arbitrations. He has represented individuals, small businesses, large national corporations, and everything in between.

Stephen also has a broad range of experience in other areas of practice including health law, creditor’s rights, and commercial litigation. He has appeared in all levels of court in Alberta and the Federal Court of Canada. He also frequently appears at the Alberta Labour Relations Board.

Lucinda Wong
partner
Lucinda is a partner at Carbert Waite LLP practising in employment, immigration, and commercial litigation.

She has acted in a wide variety of complex litigation matters from inception to trial, as well as judicial reviews, appeals, and judgment enforcement. Lucinda has appeared before the Alberta Court of Justice, Court of King’s Bench, Alberta Court of Appeal, Federal Court, the Immigration Appeal Division, and the Refugee Protection Division.

Lucinda has advised and represented both employers and employees on a range of issues, including workplace terminations, constructive dismissal, employee discipline human rights matters, workplace policies, and on the treatment and procurement of foreign workers. As an immigration lawyer, Lucinda possesses experience with a variety of permanent resident applications, judicial reviews of negative immigration decisions, in-Canada humanitarian and compassionate claims, refugee claims, family class sponsorships, spousal sponsorship appeals, residency obligation appeals, pre-risk removal assessments (PRRA), inadmissibility, removals, immigration detention reviews, and applications for temporary residence.
